What is the VTEX DAY App?
Services VTEX DAY is a platform that enhances communication and relationships between people and organizes this information through customized applications for your event.
Suspension. We reserve the right to suspend or terminate your access to the application at any time in the event of suspected fraud, obtaining a benefit or advantage unlawfully, or failure to comply with any conditions set out in these terms of use, the privacy policy or applicable law. In such cases, no compensation shall be due to you, and VTEX DAY may bring the appropriate action for recourse, if necessary, as well as take any other measures necessary to pursue and safeguard its interests.
How do I access the VTEX DAY application?
Access. To access VTEX DAY and use its features, you must register. To register, you will provide us with personal information, as described in our privacy policy. To learn more about the privacy of your personal information on VTEX DAY, please visit our privacy policy.
Age of use. To use VTEX DAY, you must be at least 18 (eighteen) years old. If you are under this age, you may use VTEX DAY provided that you are supervised by your parents or legal guardians and provided that they have read and expressly agreed to these terms of use, through the following technical solution: registering your credit card number or signing a consent form to be provided.
Ownership. Once you have registered, you will be the owner of an account that can only be accessed by you. If VTEX DAY detects any account made from false information, by users who, for example, do not have the minimum age allowed, that account will be automatically deleted.
Updating information. You hereby agree to keep your personal information up to date. You also agree that you will keep your login and password secure and out of the reach of third parties, and will not allow your VTEX DAY account to be used by others. You are therefore responsible for all actions taken on your account.
What rights does VTEX DAY have over the application?
Our rights. All rights relating to VTEX DAY and its functionalities are the exclusive property of VTEX DAY, including its texts, images, layouts, software, codes, databases, graphics, articles, photographs and other content produced directly or indirectly by VTEX DAY ("VTEX DAY content"). VTEX DAY content is protected by copyright and intellectual property law. It is prohibited to use, copy, reproduce, modify, translate, publish, transmit, distribute, perform, upload, display, license, sell or exploit and reverse engineer VTEX DAY content for any purpose without the prior express consent of VTEX DAY. Any unauthorized use of VTEX DAY content will be considered a violation of VTEX DAY's copyright and intellectual property rights.
Intellectual property over the software and materials made available
Intellectual property. For us at VTEX DAY, the quality of the materials made available to the user is of paramount importance. Their creation is the result of hard work and dedication on the part of our developers. Therefore, we reaffirm that VTEX DAY guarantees that all rights, title and interest (including, but not limited to, copyright, trademark and other intellectual property rights) in and to the service provided by us shall remain vested in VTEX DAY.
Non-acquisition of rights. The user shall not acquire any ownership rights over the services and contents of VTEX DAY, except where expressly granted in these terms of use.
Downloading content. It is forbidden for the user to download our content in order to store it in a database and offer it to a third party other than the user. It is also forbidden for the content provided by us to be used to create a database or service that could compete in any way with our business.

User and VTEX DAY responsibilities
Responsibility for use. You are solely responsible for your use of VTEX DAY and must comply with the rules of these terms of use, as well as the legislation applicable to VTEX DAY.
Responsibility for the use of the timeline. All images, videos and texts published by users on the app's timeline are considered "public information" and may even be shared on external social networks by other users.
Liability for any damage.
VTEX DAY, its controller, affiliates, partners or employees shall in no event be liable for direct or indirect damages arising out of or in connection with the access, use or inability to access or use VTEX DAY.
Non-liability. In view of the inherent characteristics of the Internet environment, VTEX DAY is not responsible for interruptions or suspensions of connection, incomplete or failed computer transmissions, as well as technical failure of any kind, including, but not limited to, electronic malfunction of any network, hardware or software. The unavailability of access to the Internet or to VTEX DAY, as well as any incorrect or incomplete information about VTEX DAY and any human, technical or other failure in the processing of VTEX DAY information shall not be considered VTEX DAY's responsibility. VTEX DAY disclaims any liability arising from such facts and/or acts.

Disclaimer. When VTEX DAY facilitates your interaction with independent third party providers, such as companies, startups and event promoters, this does not mean that VTEX DAY endorses, verifies, guarantees, has any connection with or recommends such third parties. In such situations, VTEX DAY acts as a mere facilitator of the transaction between you and such third parties, so VTEX DAY is not a supplier of goods or services, which are provided directly by independent third party providers. VTEX DAY will not, under any circumstances, be responsible for such products or services of third party providers and we reiterate the need for the user to read, analyze and accept the terms of use of the platforms that may have some interface with us.
How does VTEX DAY deal with the content you and other users produce?
Content creation. VTEX DAY may, at its sole discretion, allow you or any other user to submit, upload, publish or otherwise make available on the application text, image, audio or video content or information ("user content").
Prohibited content. Any user content of a defamatory, libelous, insulting, violent, pornographic, obscene, offensive or unlawful nature is prohibited, as determined by VTEX DAY in its sole discretion, including proprietary information belonging to other persons or companies (e.g. copyright, trademarks), without the express authorization of the holder of such rights, the infringement of which shall not be the responsibility of VTEX DAY.
Ownership of content. Any user content you provide remains your property. However, by providing it to VTEX DAY, you grant us a worldwide, indefinite, royalty-free, transferable license and right to sublicense, use, copy, modify, create derivative works from, distribute, publish, display such user content in all possible formats and distribution channels, without further notice to you, and without any payment, as long as it relates to the operation of the platform. In addition, access passwords are protected by encryption, which means that we will be "blind" to this content.
Deletion of content.
VTEX DAY may, but is not obligated to, review, monitor and remove user content, at VTEX DAY's sole discretion, at any time and for any reason, without any notice to you.
What else do I need to know about these terms of use?
Changes. To improve your experience, VTEX DAY is constantly being updated. For this reason, these terms of use may be changed at any time to reflect the adjustments made. However, whenever any changes occur, you will be informed in advance by the e-mail address you provided at the time of registration or by a prominent notice in the application. If you do not agree with the new terms of use, you can reject them, but unfortunately this means that you will no longer be able to access and make use of VTEX DAY. If you use VTEX DAY anyway, even after these terms of use have been changed, this means that you agree to all the changes.
Conflict between provisions. In the event of a conflict between these terms and the modifying terms, the later terms shall prevail with respect to such conflict.
Law and jurisdiction. These terms of use are governed by the laws of the federative republic of brazil. Any doubts and situations not provided for in these terms of use will be resolved first by VTEX DAY and, if they persist, shall be resolved by the courts of the district of londrina, paraná, to the exclusion of any other, however privileged it may be or may come to be.
